These Terms and Conditions and End User License Agreement (“Terms”, “Agreement”) govern your download, installation, and use of the GoodKarma mobile application (“App”), developed by GoodKarma (“we”, “us”, or “Developer”).
By downloading, accessing, or using GoodKarma, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download or use the App.
1. Purpose of the Application
GoodKarma is a dedicated spiritual companion application designed to assist devotees in maintaining daily spiritual discipline, Naam Jap, mantra chanting, and mala counting (108 bead cycles). The App is intended for personal spiritual contemplation, devotional practice, and wellness.
2. License Grant & Scope
We grant you a revocable, non-exclusive, non-transferable, limited personal license to download, install, and use GoodKarma on Apple-branded devices that you own or control, in accordance with the Usage Rules set forth in Apple Media Services Terms and Conditions.
3. Apple Standard Minimum Terms of Use (EULA)
In accordance with Apple App Store requirements, you acknowledge and agree to the following provisions:
- Acknowledgment: This Agreement is concluded between you and GoodKarma only, and not with Apple Inc. (“Apple”). GoodKarma, and not Apple, is solely responsible for the GoodKarma application and its content.
- Maintenance and Support: GoodKarma is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty Disclaimers: To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to the App. Any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of GoodKarma.
- Product Claims: You acknowledge that GoodKarma, and not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- Intellectual Property Rights: You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, GoodKarma, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
4. Free Spiritual Service & No Subscriptions
GoodKarma is made available as a free devotional utility. There are no mandatory fees, paywalls, or auto-renewing subscriptions required to access core Jap counting, 108 mala tracking, speech recognition, and 12-language support.
5. User Conduct & Prohibitions
While using GoodKarma, you agree not to:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
- Interfere with, tamper with, or compromise the security or integrity of our backend sync servers or databases.
- Use the App for any commercial exploitation, automated spam, or unauthorized redistribution.
- Upload, store, or transmit any unlawful, offensive, defamatory, or harmful content.
6. Intellectual Property & Sacred Texts
Traditional sacred mantras, scriptural chants, names of deities, and ancient Sanskrit / Indic verses referenced within the App belong to universal cultural and spiritual heritage.
The software design, custom user interface, logos, typography arrangements, sound synthesis algorithms, and proprietary source code of GoodKarma are protected by copyright and intellectual property laws. All rights not expressly granted herein are reserved by GoodKarma.
7. Disclaimer of Medical & Professional Advice
GoodKarma is designed for spiritual contemplation and devotional practice. It does not provide medical, psychological, psychiatric, or healthcare advice. Chanting and breathing exercises should be practiced comfortably according to your own physical capabilities.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall GoodKarma, its developer, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the App or any content therein.
9. Termination
This Agreement remains in effect until terminated by you or by us. You may terminate this Agreement at any time by deleting the App and all copies from your devices. We may terminate or suspend your access immediately without prior notice if you breach these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable to consumer applications, without regard to conflict of law principles.
